Recycling Exclusion (DecaBDE)
Definition
DecaBDE in pre-existing plastics in the waste stream can be recycled under this exclusion, but facilities must implement regulated areas, signage, and PPE. Does not apply to new DecaBDE manufacturing.
Source
40 CFR § 751.405; EPA Final Rules (2021, 2024).
Practical Explanation (Compliance Context)
The recycling exclusion prevents diversion of DecaBDE-containing plastics to landfill. However, it is conditional on workplace safety measures including NIOSH-approved respiratory protection.
