General Provisions (40 CFR § 751.401)

The general provisions section applies across all five PBT chemicals in Subpart E. The 2024 revision added the repair and maintenance exclusion here, applicable to all PBT chemicals. General provisions also establish the applicability of Subpart E and cross-cutting definitions.

The general provisions are important because they contain cross-cutting exclusions that apply to all five chemicals. The repair/maintenance exclusion was placed here rather than in individual chemical sections, making it universally applicable.

A company repairing equipment containing any of the five PBT chemicals can rely on the general provisions repair exclusion at § 751.401 without needing to check each chemical-specific section separately.
