Repair and Maintenance Exclusion

The 2024 revision (40 CFR § 751.401) excludes processing/distribution of articles for repair or maintenance where the PBT chemical has not been newly added. Applies to all five PBT chemicals.

Allows servicing and redistributing existing PBT-containing equipment without triggering prohibitions—provided no new PBT material is introduced during repair.

An OEM reconditioning a PIP (3:1)-containing pump housing without adding new PIP (3:1) is covered by the exclusion.
