EPA (Environmental Protection Agency)

EPA is the federal authority administering and enforcing TSCA, including PBT restrictions under Section 6(h). EPA promulgated the 2021 and 2024 PBT rules, conducts inspections, and enforces compliance with civil penalties up to $51,489/day/violation.

TSCA § 2(a); 15 U.S.C. 2601 et seq.; 40 CFR 19.4.

EPA is the sole TSCA PBT enforcement authority. Companies must provide documentation upon request and maintain records per EPA requirements. TSCA violations can result in significant civil and criminal penalties.

EPA inspects a facility and requests PIP (3:1) compliance records. The facility must provide five years of documentation.
